EPA Workers Receive Emails Warning their Employment might Be Terminated

More than 1,100 staff members at the Environmental Protection Agency received notification today that they were deemed to be on probationary status and cautioning they could be fired instantly, according to an email acquired by CNN.

Probationary employees getting the e-mail have been working at the firm for less than a year. The emails started to go out late on Wednesday afternoon, according to an EPA union official.

The same message will be sent out to other company workforces, a White House authorities said. Across the US government, the most current information shows there are more than 220,000 workers on probation.

“As a probationary/trial duration employee, the agency has the right to right away terminate you pursuant to 5 CFR § 315.804,” the EPA email to probationary employees reads. “The process for probationary removal is that you get a notice of termination, and your work is ended instantly.”

“Each staff member’s status will be figured out separately,” the email includes.

The email also define an appeals process staff members can require to see if they are qualified for extra defense.

The method is comparable to how Elon Musk, now a key Trump adviser, managed layoffs when he purchased Twitter – make a new e-mail alias (in this case, notice@epa.gov) and job then send out mass termination letters to everybody on it.

The US Office of Personnel Management declined to comment, and the White House and EPA did not respond to requests for extra remark.

The EPA union official stated these probationary employees aren’t the exact same as at-will workers; they have less security than tenured workers, but they have rights to appeal.

The union official stated EPA will have to make a finding as to every probationary worker that is being let go – either that their efficiency is poor or that they had a disciplinary problem. Veterans and those with period have extra layers of security. Attorneys who operate at the EPA and AFGE, the union representing a large number of EPA workers, are counseling people who are probationary staff members on how to respond to these e-mails and waiting to see what further action is taken.

The EPA emails come after the Office of Personnel Management sent out a mass email to federal workers Tuesday night informing them if they resign now, they would be paid through September 30 although they likely wouldn’t need to work, or might a minimum of keep working remotely.

The e-mail defined that those who pick not to opt into the program – described as a “deferred resignation” offer – can’t be given “complete assurance relating to the certainty” of their position or agency moving forward. It added that, should their job be eliminated, job they “will be treated with self-respect and will be paid for the defenses in place for such positions.”

The e-mail, sent out from a new government alias HR1@opm.gov, included the subject line “Fork in the Road,” the exact same subject line of a final notice message Musk sent to his employees at Twitter in 2022.

Musk has made clear in recent months that a leading concern for the Department of Government Efficiency, which he is helming, would be to rid the federal workforce of staff members deemed as underperforming.

Marie Owens Powell, president of American Federation of Government Employees Council 238, stated morale at EPA was suffering.

“It’s bad, it’s probably the worst I have actually ever seen,” she said. “I’ve never ever seen anything like this. Literally every day, folks hesitate to turn their computer systems on. They do not know what message will be coming out next.”

Mass layoffs of probationary employees could disproportionately affect more youthful employees, job said Rob Shriver, acting director of OPM under President Joe Biden.

“There has been a longstanding battle to get more youthful people thinking about public service,” Shriver said. “We strove to repair that, employing approximately 13% more people under the age of 30 in 2024 than 2023.
